It's not smart to kill someone who's upside down. You are with 1 player more for 10 secs and that can make a huge difference in XP (but also in other normal battles)

Destroying tanks, whether they are upside-down or not, is legal as it is a part of the game. It isn't a wise move in XP battles though.
