I returned back to the game after a week of absence only to see the mess generated by the new update. It's good I was on holiday so i am kind of off the gaming addiction to be honest, so I can just leave as well. Or at least until they decide to remove the stupid "hours played" from your profile.

I would like the developers to explain to us why we can not view their profile, while we can view pretty much every normal user's profile. For example:

@amelin

@arts80

@Anton Volkov

@vitaly

@denton

@dragonfly

What do you guys have to hide? Why did you want to restrict your data from the public view, and let everyone else out there in the open without asking first?

True discrimination.

While I do not see why people want to hide how many hours they played, I can see the problem with the devs hiding their own information. This suggest malicious intent at their end.

Now that I had time to think about it. This is probably another bad update.

82d.gif

Now raiders could see what weapons you use, paints you have and use their opposites against you. No wonder so many tankers started to use Annoying Vulcan in CP matches lately & some keep switching... Selected information determined by the user should be displayed only.

I still don't like the idea of how many supplies I used in battles being displayed. :angry:

More whiners have appeared in battles, LOL.

That fuels competitiveness. You are "motivated" (read forced) to buy more equipment, paints, and upgrades, and guess what? That is wonderful for the economy. XAXAXAXAXA!

I love being a Gizmo. I do not have any more goals. I can quit or play whenever I want, and I do not care about the ratings. Nobody can surprise me by finding out that I am neither the best nor the worst player in the game or the player that plays most or least or have most or least equipment. I know that, and I have said it before many times.

Anyone else is having this bonus bug? I don't have premium and I don't

get those bonus crystals.Screenshot_8.png

This is not a bug. This is TO showing you how many crystals you miss by being a loser, I mean a free player. I get this since this update. Everybody does.

I don't see what's wrong. You are playing a PUBLIC game on the internet, where basically everything can be made public. Take the TalkTalk hackings for example, where ACTUAL PRIVATE INFORMATION, not something as meaningless as the total game time, was stolen. Follow a basic concept - whatever you write or whatever you do online can be revealed to anyone. Simple.

Simple, right. In fact hacking is simply illegal.

When you started to play TO, you "signed" an agreement. Did TO violate it? If so, you can sue them. If not, you legally have to shut up.

Sorry, life is tough.

Sorry, life is tough.

1. We do not legally have to shut up, unless the court specifically orders the individual to do so, but people also are allowed to legally disagree with us.

2. You are correct that one can attempt to sue TO but I'd advise against it because this new contract is based in Malta NOT in Russia, and in Malta all other nations' laws are irrelevant no matter where we are. Also in Malta, many white collar (professional/office) unconvicted criminals reside and base their headquarters in. This does not automatically mean that TO or its people are criminals, but it does mean that no matter what our contract said about our rights and responsibilities are not relevant anyway due to the contract being based out of the country of Malta and how the Maltese govern there.

3. But I do request that TO at least fulfil our privacy requests from the goodness that is left in their hearts, no matter how much or little is in there.

In that case, you can sue the Maltese government.

You do not have to be rude though, but you may want to because of the badness in your heart no matter how much or little in in there..

so because others reveal private information to the public, you don't see what's wrong by doing the same here? And we are not even talking about someone hacking private information, we are talking about the same people who are legally holding your data, making it available to the public without your consent.

Even though I am 70% sure the devs will remove the time counters, I would like to show you one section of the EULA, which you agreed to when joining the game.

User hereby grants the Company the irrevocable right to use, unlimited in time and territory, the Material(s) which User has placed in the Game

or has sent to the Company (including for participating in a competition) and that from the moment of placement (publication) or sending by Users of these Material(s) in the Game the Company shall receive right to use these Material(s) either to the extent required to provide the possibility to participate in the game and/or use the offered services or for other purposes, including the time-limited use in specific commercial and/or advertising campaigns related to the Game, and shall have the right to use the Materials for those purposes without restriction as to content, including in particular the right to place, modify, adapt, transfer or sublicence to third parties, create derived Materials, redevelop Materials, distribute, delete, reproduce, show publicly, make available to the public

and effect any changes, reductions, additions, comments, explanations to the Material, to publish Materials, to use Materials and/or otherwise without specifying User and without any royalty or other compensation. User undertakes to provide legal grounds of rights’ transfer to the Company concerning the Materials placed by the User in the Game or on the Site.

Where "Materials" is defined as:

“Material(s)” shall mean the different objects in the form of texts, drawings, images, sounds, programs, commands, names, subjects, stories, dialogues, phrases, concepts, illustration, animations, sounds, musical compositions and effects, documentation, game chats or any other form and include any other derivative material, placed in the Game by User or the Company.

Where "documentation" can be defined as "material that provides official information or evidence or that serves as a record."

So you agreed to allow them to collect documents (eg. hours played) and use, without your permission, to show publicly.

So you agreed to allow them to collect documents (eg. hours played) and use, without your permission, to show publicly.

First and foremost, just because something is legal it does not make it right as well. For example, you can always go around your town, knocking everyone's door and asking them if they are kind enough to sign a piece of paper handing in all their belongings to you. Statistically speaking, after knocking thousands of doors, at least one will be stupid enough to sign that paper. This is legal. Should you do it? You know the answer to that question.

Now to talk in more legal terms, let's see what it is that you are quoting.

User undertakes to provide legal grounds of rights’ transfer to the Company concerning the Materials placed by the User in the Game or on the Site.

Here you state that the company has the right to make available to the public some Materials and you define those materials as follows:

“Material(s)” shall mean the different objects in the form of texts, drawings, images, sounds, programs, commands, names, subjects, stories, dialogues, phrases, concepts, illustration, animations, sounds, musical compositions and effects, documentation, game chats or any other form and include any other derivative material, placed in the Game by User or the Company.

Now let's look which of those actually has anything to do with the hours spent playing the game:

texts: no

drawings: no

images: no

sounds: no

programs: no

commands: no

names: no

subjects: no

stories: no

dialogues: no

phrases: no

concepts: no

illustration: no

animations: no

sounds: no

musical compositions: no

effects: no

documentation:

For this you write

Where "documentation" can be defined as "material that provides official information or evidence or that serves as a record."

I am sorry but this is not how the law works. You don't get to define things however you want. The law defines them for you. And apparently that is not the case here. Documentation can also be any documents storing your personal information like real name, address, credit card number. If you can define documentation however you want, I can do the same and define it as anything storing what I stated in my previous sentence. So now tanki online can make your credit card available to the public, your name and your street address. That's great!

let's go on:

game chats: no

any other form and include any other derivative material, placed in the Game by User or the Company:

no again just as in the documentation, this can be interpreted differently by anyone, the user generates material every time they buy something, as described above. So this would give the company the authority to do what ever they want with this material. And I am pretty sure you would be among the first to cry for privacy when they decide to put your real name out there in the public.

So, I am sorry but I don't see your point. It's not there, like at all. Both morally AND legally speaking.

No where in the use of terms do they suggest explicitly that this company has the right to store information about how much time you spend playing the game.

And even if they did, which they don't, all we do is, we ask them not to. We ask them to respect the fact that some people do not want others to find out how much time they spend on this game. Everything else we do not care about. Why do you need the hours spent when you have the experience gained by using some gear?

So please, listen to the community, like I said before not everyone here is a child, some of us do have jobs, spouses, friends and want to keep a low proflie when playing this game. By putting the time we spend in this game out there, you automatically put everyone at risk of unnecessary exposure.

Firstly, it is legal. Whether it is right or not, you agreed to it.

This was not defined by me. The definition of "Material(s)" was defined by Tanki in their EULA. A legal definition of "document" (provided by thelawdictionary.org) is:

An instrument on which is recorded, by means of letters, figures, or marks, matter which may be evidentially used. In this sense the term “document” applies to writings; to words printed, lithographed, or photographed; to seals, plates, or stones on which inscriptions are cut or engraved ; to photographs and pictures; tomaps aud plans. The inscription may be on stone or gems, or on wood, as well as on paper or parchment. 1 Whart Ev.

Law Dictionary: What is DOCUMENT? definition of DOCUMENT (Black's Law Dictionary)

And yes, you have agreed for Tanki to enclose any type of document, which means they can post your real name or address (if you provided it to them) but they have agreed to be "construed in accordance with the Laws of Malta and shall be subject to the jurisdiction of the Courts of Malta. [22.1]"

No where in the use of terms do they suggest explicitly that this company has the right to store information about how much time you spend playing the game.

In fact, I have found a better clause in the EULA that backs up my point:

The Company shall have the right to display and publish any information relating to User activity on the Internet Site and/or the Game in any list without any notice or compensation to User whatsoever.

What more can be said? Edited by MusicJam19

Sorry, life is tough.

Don't ever tell me life is tough in such superior and arrogant way, cause you do not know anything about how my life is, BABY.

And since we all signed an agreement, why did mods and devs hide their stats? Nobody, neither you with your arrogant behavior, gave me a satisfactory answer.

Nothing, you simply don't get the point.

I do. But you have to understand that you brought it upon yourself - if you didn't want to have your game statistics shared, you should have read the EULA and not sign up.

It only states that they can publish this information, but it doesn't say that it must publish every single person's information
