Yes. This happened on my 2nd LT account - 8 M3 modules.

The module upgrade. Anything that was MU'd to 35%+ before the module upgrade was automatically made to M3.

According to the Wiki, a Single M3 Firebird protection module was available for purchase at the rank of Brigadier. So assuming he hasn't ranked up since the latest module update, this would be the most likely answer why has has M3 protection.
