You can try recording the player using third-party software and report it in the Game Violation Reports section. Alternatively, with patch update #516 it makes reporting game violators slightly more easier than before, assuming the violator doesn't leave the battle that is. I'd personally go for the first option as it gives a more secure report against the players as there are multiple factors where the /vote [playername] will fail, such as having no battle moderators online or having 15% of the players vote for the player.

I can't speak for the rest of the helpers, but all battle moderators work together with each other from different communities so I believe they are in full right to ban other players regardless of the language or nationality barriers.
