The players with cosmetically M3 items bought them before the ranks of M3 equipment were changed. These M3's are now only available at Marshal, or as early as Lieutenant General in the form of kits. These players are rare and don't affect balance too much unless the item is heavily upgraded, so you'll just have to use your fully upgraded M2's till you reach the rank which M3 kits unlock.
